THE PHOTOGRAPHY WEDDING CONTRACT

GOVERNING LAW

Any contract made between the photographer(s) and the client(s) shall in all respects be governed by and construed in accordance with English Law and the parties hereto submit to jurisdiction of the English courts.

ENTIRE AGREEMENT

This agreement contains the entire understanding between Fun 4U Photos/Fun 4U Photography and the client. It supersedes all prior and simultaneous agreements between the parties.

PERFORMANCE

The performance of this contract on behalf of Fun 4U Photos and Fun 4U Photography shall be contingent upon acts of God, flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or conditions beyond its control.

SEVERABILITY

If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.

AMENDMENTS

This contract has been freely negotiated and shall be recognised as the entirety of the agreement. Only those changes or modifications specifically placed in writing, attached, dated and signed by the client and Fun 4U Photos/Fun 4U Photography at the time of acceptance of this contract shall be recognised as amendments to this contract.

It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

This contract for wedding photography services is effective from the date it is signed by the representative of Fun 4u Photos/Fun 4U Photography and the Couple.

FUN 4U PHOTOGRAPHY.

Fun 4U Photography is responsible for the taking of photos for all occasions and events, both personal and commercial.

This service includes photo editing and sales services and includes receiving customer photos to scan and edit/enhance and photos taken by Fun 4U Photography and sales of enhanced and original photos.

FINANCIAL

The deposit is due on signing this agreement, with the balance due on or before the day of the wedding.

All standard photographic services and optional extras specified in this contract and paid for in full before the wedding, are supplied at the prices ruling on the date of signing of the contract. Optional extras not paid for in full before the wedding, are supplied at the prices ruling at the time of receipt of the order.

The client(s) will be liable to pay any additional expenses incurred by the photographer(s) not already included within the contract price. This includes for example access fees charged by some venues, and dispatch of prints, discs, albums, and other products to non-UK addresses. Travel expenses (other then specified in the contract summary) need to be covered at full cost before the journey takes place.

All additional goods must be paid for in full on ordering. This includes web pages, extra prints, albums, special editing and rendering of images, high-resolution digital files, high resolution long term web galleries, and any other services ordered after the event.

The Client(s) may upgrade or degrade the package at any time. No additional charges apply. Written consent is required. The Client(s) have to pay the difference between the the amount already paid and new amount due. Any differences cannot be refunded when degrading the package.

Any alterations made to the booking by the client(s) once details have been confirmed may only be made at the discretion of the photographer(s) and in some circumstances (such as the change of ceremony date for a wedding) the photographer(s) may be unable to accommodate these alterations due to a conflict of commitments. The Client(s) may change the date booked earlier, if somebody else has not booked it already. No additional charges apply and written consent is required. The photographer cannot take responsibility in the event when the new date is booked or other responsibilities need to be carrying out on this date. No refunds will be given. Under these circumstances the photographer(s) are not liable to compensate the client(s) in any way.

Due to the nature of the product the photographer(s) are unable to give exchanges or refunds. This does not affect your statutory rights.

BOOKING DEPOSITS

In the event of the bride and groom cancelling the wedding for whatever reason the booking deposit is non refundable.

The Couple agree to pay a £150 non-refundable booking fee.

The Couple agree to pay the full balance of the photography package purchased at least 60 days prior to the wedding date.

The Photographer agrees that every effort will be made to provide the highest quality photographic services in the prevailing conditions.

PAYMENTS

a) A non-refundable retainer for the amount specified in your contract summary (paid by cash, cheque, credit / debit card or online bank transfer) along with a completed contract will confirm your booking. The retainer forms part of the total cost of your Package (i.e. it is NOT in addition to the cost of the plan) and is deducted when calculating the final balance due. The retainer (deposit) secures the photographer’s services for the period of time specified in the contract and is non refundable in any event. The photographer will decline any other enquiries for the time specified upon receiving this fee.

PENALTY FEES & CHARGES

The booking fee is payable within 14 working days from the date of booking.

There is a £100.00 late payment fee for any payments that are not postmarked or delivered to Fun 4U Photos and Fun 4U Photography within 14 days of signing this contract. If the payment is not received within 21 days, the reservation will be automatically removed and the date will become open for booking.

Payment for any outstanding balance is due in full NO LATER THAN 60 DAYS prior to the contracted date and is specified in your contract summary:

You MUST allow sufficient time for cheque clearance.

Non-receipt of the full balance by the due date will be deemed cancellation of the contract by the client(s) and the deposit will be retained by Fun 4U Photos/Fun 4U Photography.

METHOD OF REMUNERATION

Payment may be made in cash or paid by cheque. Final delivery will only be made after funds are cleared.
