LIMIT OF LIABILITY

In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer. Fun 4U Photos/Fun 4U Photography will make every effort to secure a replacement photographer able and/or willing to provide a similar package as chosen in this contract at the same/similar tariff. However it may prove difficult or impossible to find a skilled replacement photographer at short notice or at the same price.

In the unlikely event of total or part photographic failure, death, injury or illness, accident or other unforeseen event beyond the Photographer’s control, the Photographer’s liability shall be limited to a full refund of all monies paid and the

If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package, with the deduction of any monies paid for work already carried out, such as engaged couple portraits etc and any expenses incurred that the client(s) agreed to reimburse. Photographer shall not be responsible for other consequential damages, emotional or otherwise.

Fun 4U Photos and Fun 4U Photography takes the utmost care with respect to exposure, transportation and processing of photographs; including using professional grade equipment and professional grade backup equipment. We have working methods in place to prevent the loss or damage to your images (the digital images are backed up constantly to separate storage media and duplicate equipment is on hand in case of breakage or failure). However, in the unlikely event of photographs being lost, stolen or destroyed for reasons within or beyond Fun 4U Photos and Fun 4U Photography control, the latter’s liability is limited to the return of fees received for the event package. The costs of re-shooting cannot be attributed to Fun 4U Photos/Fun 4U Photography.

The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of originals shall be the prorated amount of the photos lost, based on the percentage of total number of originals.

RESERVATION

Upon your signature, Fun 4U Photos/Fun 4U Photography will reserve the time and date agreed upon, and will not make other reservations for the time specified in the contract. For this reason, the Reservation Deposit is non-refundable, even if the date is changed or the wedding cancelled for any reason; including acts of God, fire, strike and/or extreme weather.

PRIOR TO THE EVENT

CONFIRMATION: A signed wedding contract and deposit are necessary to confirm the stated wedding services from Fun 4U Photos/Fun 4U Photography at the date and time specified.

PRE-WEDDING CONSULTATION

This normally happens at the time of booking. The bride and groom will outline broadly what is required and Fun 4U Photos/Fun 4U Photography will advise on planning, logistics and timings where needed.

The parties agree to a pre-event consultation before the wedding date in order to finalise the actual shooting times and locations.

The bride and groom agree to have contact with the Fun 4U Photos/Fun 4U Photography when required prior to the wedding, to iron out the remaining details.

In any case we expect to have contact with you by phone a few days before the wedding to ensure that there have been no last minute changes.

CANCELLATION

In the event that the client cancels the contracted services for wedding photography outlined in this contract before the wedding ceremony takes place, the deposit will be forfeit.

RIGHT OF WITHDRAWAL

Discovery of new information, changes to agreed circumstances, or other factors which tends to circumvent its policies may result in service withdrawal. Lack of co-operation; changes in locations, facilities or available times; missed appointments and late payments are some examples of such contributing factors.

Should Fun 4U Photos and Fun 4U Photography initiate the withdrawal, all fees will be returned, excluding deposit as well as fair market value for all services/products already provided and excluding any and all expenses incurred by Fun 4U Photos and Fun 4U Photography.

In case of withdrawal, £100.00 an hour is charged for all photography services already provided and £50.00 an hour is charged for all other services, consultations and all driving time, rounded up to the nearest half-hour. Reasonable co-operation will be given by the Photographer when changed circumstances occur.

INSURANCE

The Client(s) are hereby advised to take out an insurance policy to cover any expenses in the event of cancellation.

PHOTOS REQUIRED

The client MUST provide a full list of formal photographs required including names and relationship to the client and promise to provide a guide for the gathering of people to the formal photo locations on the day.

Prior to or during the event, the Client may also  inform the photographer of other  subjects which they would like photographed, but the final content of the images is at the discretion of the Photographer.
