THE PHOTOGRAPHY WEDDING CONTRACT - DURING THE EVENT Page 3 CULTURE AND FAITH The photographer does not claim to be aware of all important aspects of a couple’s culture and faith. It is the responsibility of the couple to make the photographer aware of any cultural or faith aspects of the wedding that will enable him to produce the best pictures for the day. E.g. Items of significance, colours, people, parts of the ceremony etc.
HOUSE RULES The photographer is limited by rules and guidelines imposed by registrars, ministers and other ceremony officials and venue management as to what can and cannot be done. For example some ministers insist that no flash photography is allowed, and others will insist that the photographer shoot from a specific location.
The movements of the photographer(s) may be restricted by the official in charge of the church or at certain venues. The photographing of parts or even all of the ceremony may be restricted or prohibited. The area from which the photographer(s) is able to cover the ceremony may not be the photographer(s) choice and the photographer(s) cannot accept responsibility for any obstructed view. The use of artificial lighting may be restricted or prohibited.
In such circumstances the bride and groom agree to accept the technical limitations that may be imposed on the equipment used and the technical results of their imposition on the photographer.
We strongly advise the bride and groom to make themselves aware of the rules of the venue and if necessary negotiate with the people concerned, making the photographer fully aware of the restrictions in good time for the photographer to make the best of the shots available. Negotiation with the officials for moderation of guidelines is the client(s) responsibility; Fun 4U Photos and Fun 4U Photography” can offer technical recommendations only.
If the Photographer is unable to perform due to fire or other casualty, strike, or a cause beyond the control of the parties, or due to the Photographer’s illness or injury, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to this agreement. This limitation on liability shall also apply in the event that images are lost through equipment malfunction, lost in the mail or otherwise lost or damaged without fault on the part of the Photographer. In the event that the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the Photographer’s fee. The photographer will retain expenses and fair market value for work already undertaken. Photography services outside the UK are subject to special conditions.
EVENT GUIDE: The client(s) agree to designate an “event guide” to point out important individuals, objects and locations to the photographer.
For a wedding or other event booking the photographer(s) shall endeavour to capture all the moments throughout the day as they occur. However, because of the fluid nature of the event, some moments might not be recorded, or not recorded for logistical reasons.
When using digital photography, the Photographer(s) will be under no obligation to display the images while the event is still underway.
The Photographer(s) will document the events in a candid manner and take formal portraits as necessary.
The Client will be responsible for (or have someone designated for) identifying people/objects of whom/which specific photographs are desired. The photographer will not be held accountable for not photographing desired people, items and locations if there is no one to assist in identifying or gathering people for the photograph(s) and pointing out items and giving access to locations. The guide will also ‘round up’ groups for formal photographs. This leaves the photographer free to continue shooting.
The photographer(s) shall endeavour to photograph all individuals as requested by the client(s) at some point during the event, but no responsibility will be taken by the photographer(s) on the occasion of excluding anyone.
Photographs taken during the course of the event will be at the discretion of the photographer(s) although every effort will be made to comply with the client(s) requirements.
THIRD PARTIES An inconsiderate guest or member of the public can wreck the photographic record of your special day and we may speak with the guest, member of public, bride or groom or coordinator if appropriate. Coverage may be cancelled without warning at the discretion of the photographer if the photographer feels threatened or has reason to believe that equipment may be damaged.
The Photographer will stay with The Client(s) during the day for as long as it is required to capture all aspects of the event specified by the chosen package.
GUEST CO-OPERATION: The Client(s) is responsible for the conduct of their guests and will direct all other service providers (florist, caterer, etc.) to provide any needed information and cooperation to the photographer before and during the event.
Co-ordination with other service providers is necessary to complete all the photography sessions as scheduled. The client should share the photography schedule with other service providers to make sure that there is no conflict in times. In addition, events during the wedding day should be planned to make the best use of time from all vendors.
Fun 4U Photos and Fun 4U Photography will not tolerate verbally or physically abusive behaviour, nor will it share its time or compete with guest photographers for the attention of the subjects.
Guest conduct that interferes with photography may seriously affect the quality and quantity of the photographs and increase the number of times photos must be re-taken. If the client(s) is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any guest damages or threatens to damage the equipment of the photographer, it will result in the early or immediate departure of the photographer. The client(s) understands that in such an event no refund will be granted as the photographer has attempted to fulfil the terms of the contract and committed the time in doing so.
Please note that not all guests at wedding like having their photo taken. In such cases the wedding photographer will use his discretion but cannot be held responsible for a lack of photos of these people
CO-OPERATION OF THE COUPLE The photography schedule and selected methodology are designed to accomplish the goals and wishes of the client(s) in a manner enjoyed by all parties. The client(s) agrees that positive co-operation and punctuality are essential and that shooting must commence at the scheduled time. Should the ceremony start late due to any reason whatsoever, Fun 4U Photos and Fun 4U Photography will not be held liable for any photographs not taken.The client(s) agree to full and positive co-operation and communication for the best possible result within the definition of this assignment. Fun 4U Photo/Fun 4U Photography is not responsible for key individuals’ failure to be present or their lack of co-operation during photography sessions, or for missed images due to details not revealed to Fun 4U Photo/Fun 4U Photography.
The bride and groom agree to set aside at least 30 minutes before the ceremony and a 60 minute time frame afterwards for photographs (including group photos) that cannot be obtained during the ceremony or reception. If either the bride’s or groom’s late arrival (or any other reason outside of the photographer’s control) prevents this 90 minute window from occurring, Fun 4U Photos/Fun 4U Photography shall not be held liable for failure to take desired photographs.
The bride and groom also agree to give the photographer sufficient warning of key events at the wedding to give the photographer time to prepare. E.g. Bouquet throwing, cutting the cake, first dance, speeches etc. |
